General

Legal & License.

GetFutura warrants that the functions included in the work undertaken will match the Client’s demands and that the operation will be honestly error-free.

The complete risk as to the quality and performance of the final work is with the Client.

In no event will GetFutura be liable to the Client or any third party for any damages, including losts of profits, lost savings or other incidental, eventful or special damages resulting out of the operation of or incapacity to operate the website, even if GetFutura has been advised of the possibility of such damages.

If any stipulation of this agreement shall be illegal, void, or for any reason was unenforceable, then that procurement shall be deemed severable from this agreement and shall not affect the efficacy and enforceability of any remaining provisions.

PAYMENT TERMS

General.

Once a work agreement has been accepted by GetFutura, the Client will be responsible for payment in full of all fees set forth therein.

All payments due hereunder are in US Dollars and are exclusive of any sales, use, or similar applicable taxes, which shall be the sole responsibility of Client.

a. Manner of Payment.

The Client may pay for all sums payable under the identified agreement by credit card (the “Client’s Card”), Bank transfer (from Client’s bank account), or such other form of payment as GetFutura may, in its sole discretion, permit. 

In the case of payment through a Bank transfer, no amounts owing are considered paid until the payment slip will be officially submitted through our email.

b. Timing of Payment.

Fees, as identified on the work agreement, are due in advance and upon delivery of the work. 

If there are Set-Up Charges (as set forth on the work agreement), such Fees shall be paid in advance together with the indicated amounts.

GetFutura shall have the right to charge the Client’s Card or debit from the Client’s account for Fees following the designated Advertising Terms and the Product Terms. 

In case of payment through Client’s Card, GetFutura sends a prenotification with a minimum notice of 2 days before collecting any due Fees. 

The Client agrees and acknowledges that all expenses owed must be paid in advance or according to the certain work agreement. In the case of Ads campaigns such as PPC campaigns and that, in addition to being in breach of its contractual obligations, Client’s Campaign(s) may be paused, terminated, if timely payment is not received.

Advertising Services

The Advertising Services consist of but are not restricted to, the following services and items (contracted for under the appropriate GetFutura project agreement):.

PPC describes GetFutura’s standard search engine marketing item, where GetFutura promotes Clients through the different online search engine in their non-organic search results page. GetFutura positions each customer’s text ads on the top Internet search engines and local directory sites so regional customers searching for keywords connected to a customer’s business, items, and services can discover such customers quickly. 

For each campaign, GetFutura’s conversion connected optimization innovation determines with time which keywords and sources drive the most results in the respective customer’s site, and is able to shift more of the Client’s media budget plan automatically to such sources.

Likewise, the business’s tracking technology replaces the contact details on each Client’s site( s) and records the related customer interaction so that customers can quickly act on leads and track the activity their campaigns produce. The outcomes of the campaigns can be accessed online at any time while the project is live.

The show refers to GetFutura’s standard online screen item, where GetFutura promotes the Client through online screen ads distributed through GetFutura’s network of online publishers.

Remarketing describes GetFutura’s behavioral targeting item that enables GetFutura to display an advertisement to consumers who have formerly evidenced interest in Client’s services or items.

Ads publishers Advertising Terms take precedence over any clashing schedule or document unless expressly specified otherwise in such a schedule or file.

As GetFutura includes other products and services, and any unique terms and conditions will be linked-to in a modified version of the task contract.

Termination for Cause. 

The parties, in case of any programmed Advertising campaign, may terminate the defined agreement, or any Advertising Service(s) granted hereunder with instant effect for an urgent reason (termination for cause).

If the critical reason is a contract breach, the termination for cause commonly requires the expiration of a reasonable restorative period or, respectively, a prior warning notice without result. 

For a termination for cause given by the Client, the remedial period generally is not less than thirty-one (31) days.”

a. No Refunds. 

Client understands and agrees that Client will not be entitled to any refunds of amounts already paid to Getfutura unless either Client terminates under the introduction paragraph above or Section (b) or Getfutura terminates under Section (a). 

Completion of Projects

Getfutura is committed to delivering all website design, logo design, and other creative projects within the time frame and specifications agreed upon in our project agreement form, for up to 6 months from the date of contract signing.

In order for Getfutura to complete projects in a timely manner, clients must provide all necessary content, assets, and feedback requested within project timelines. If a client causes significant delays by not providing requested materials essential for project completion, Getfutura is not obligated to continue work or provide refunds after 6 months have passed from the initial agreement date.

Getfutura makes every effort to deliver completed projects within 6 months provided that clients furnish required materials in a prompt fashion. However, Getfutura cannot be held responsible for timeline extensions due to delays in assets or feedback from the client side. Our aim is always timely project completion given adequate client participation.

Protocol

Web design and development projects are resource-intensive, time-consuming, and incur internal costs. As such, once a payment or deposit has been made, it is non-refundable. Payments for custom design projects (e.g., custom logo designs, branding projects, full website designs, individual page mockups, and smaller design components within a website, etc.) and custom development projects (e.g., PHP programming, WordPress CMS custom development, WordPress Plugin custom development, etc.) are made to us in increments as a courtesy to the client.


Payment & Cancellation Policy

While GetFutura extends discounts to clients who pay projects in full upfront, these payments are non-refundable should the project be cancelled, delayed, or postponed by the client.

In the event a contracted project is cancelled, delayed, or postponed by the client after work has already commenced, any monies already paid to GetFutura will be retained in full. If any additional work has been completed beyond what was already paid for at time of cancellation, the client will be invoiced and liable to pay for the value of the extra work performed.

This policy ensures reasonable compensation for any progress made on client projects in good faith, in the event of cancellation or postponement. We aim to be fair and ethical in our billing practices.


Projects that have been completed as defined by the scope of the work are non-refundable. The refund policy is not applicable if the required information for the successful completion of the project is not provided to us in a timely manner.

Any delay or failure in the completion of the project due to inadequate communication from the client cannot be attributed to GetFutura. If the client provides incomplete information or fails to provide complete information regarding the project at its initiation, GetFutura is not obliged to meet its delivery or refund commitments.

The Client is not charged with additional fees.

d. Other

Any price quoted for website projects, except if explicitly stated or agreed differently, excludes hosting of the website, domain name registering, video licenses, any extra licenses needed for the operation/running of the site, outside of those granted in the project proposal.

The website will be created with Licenced content. The Client will be in charge of any license for the additional content he/she add consequently to the terminations of Getfutura duties, such as image stock licenses and any added licenses required for the regular operation of the website.

If the Client ends work on a project, work completed shall be not refunded, considering the hours of work already spent by the Getfutura team. 

If, at the moment of the application for a refund, the project has been developed beyond the cost covered by the initial payment, the Client shall be responsible for paying for all work performed at the hourly rate stated in the project agreement.

For every website project, a timescale will be provided, for the delivery, in the project form. 

If the project time continues outside of the designated timeline due to:

Lack or delay of correspondence from the Client.

Slow or delayed delivery of content from the Client.

Changes to the initial spec/proposal by the Client.

A supplementary hourly charge may be incurred.

Once a website project is now completed, except agreed otherwise, the Client has 14 days to demand any changes that correlate to:

Interoperability Errors

Small discretional tweaks

Spelling mistakes.

After this period, unless agreed otherwise, changes may become chargeable at an hourly rate.

After a 14 day duration, if your website is not hosted on our hosting, except agreed otherwise, any errors, downtime, detection of viruses, malware, slow loading times or any problems correlating to the performance of the website or any system we install are the responsibility of the website host, we will charge an hourly rate if requested to aid in resolving any such errors.

If you choose to host your website with another host other than Getfutura and through or after the project, Getfutura will support the implementation of added time for setting up any features of the server, mail to and from the server host, new set up time as compared to using our own host: additional time will be charged at our hourly rate.

e. Website Retainers

Getfutura may offer at its discretion website maintenance work on a retainer basis.

Hours may only be requested once and not accumulated and are subject to our availability.

f. Hosting

Hosting is invoiced in advance for a minimum of a 1 year period.

If you wish to cancel or move your hosting, we require 30 days written notice.

We do not allow refunds for any hosting fees paid in advance.

If you require to drive your website/emails to a different host, we may provide an export of your website’s source code and database. 

There may be a fee to deliver these files, and if any outstanding invoices remain on your account, we reserve the right to not release any data until all outstanding amounts are settled.

If your website exceeds the hosting space or usage limit allocated as detailed/quoted an extra hosting cost may be applied, we will inform you directly via email if this is the case.

If your website or any script/file/resource connected with your website uses a massive amount of server CPU or RAM, further work may be needed to re-allocate your website to a different host OR optimize your files OR improve your server CPU or RAM capacity and price plan. (you will be notified if this is the case and this may be charged at an hourly rate).

Failure to pay hosting expenses in the stated terms on your invoice may result in the suspension of the hosting service.

After 90 days, if payment is not received, all files associated with your hosting account will be deleted.

Once any hosting service is canceled with Getfutura, the files and data may be deleted and not collected unless explicitly agreed otherwise.

e. Hosting Support

In the case when a problem with your website or email arises, if you’re hosting is through our server, you may notify us of the error via email, and we will work to resolve any issues.

In the case where an error arises from internal errors, we endeavor to solve any issues, including the monthly hosting cost.

In the case where an error arises within a situation caused by the Client, a third party to the Client, or the files of the website, an added charge to resolve the issues may be applied.

I.e. Websites are running slow due to excessive server load – endeavor to resolve any issues inclusive of the monthly hosting cost.

I.e. Websites are running slow due to a modification made by the Client – an additional charge to resolve the issue may be applied.

Getfutura Website Care Plan

Creative Brand Design may offer at its discretion a website care plan to provide ongoing support and maintenance work.

Unless stated otherwise, your hosting and website care plan entitles you to up to 1 hour of our time per month for support for your website as required.

Hours for care plans may be used at the clients’ discretion, where no requests are received from the Client within a given period Creative Brand Design at its discretion will utilize the time to perform updates/maintenance for the website.

Care plan hours cannot be accumulated or rolled over to the following period.
